Overview

The MSP Compliance Counsel acts as a resource for employees, management, clients and others regarding Medicare Secondary Payer Act and its ramifications on Medicare compliance. This position provides legal analysis of statutes, regulations or rules affecting the business and advises clients and prospective clients regarding Medicare compliance issues, settlement strategies and product offerings. The MSP Compliance Counsel provides overall support to all departments and assists in identifying and resolving legal issues as required.

Responsibilities

    Prepare written memoranda, correspondence, articles, or other documents on a variety of topics affecting the Medicare compliance industry.
  • Provide legal analysis of statutes, regulations or rules affecting the business of the company, as they relate to all departments including Human Resources, Operations and Sales.
  • Assist and/or provide expertise regarding legal aspects of current and future product offerings to ensure Medicare compliance and conformity with all applicable laws and/or regulations.
  • Perform legal research as it relates to the above or with respect to other issues as directed.
  • Advise represented clients and prospective clients regarding Medicare compliance issues, settlement strategies and product offerings.
  • Prepare and present company approved presentations and discussions at the discretion of the company on various topics and required travel.
  • Assist all departments in identifying and resolving legal issues in their daily functions.
  • Perform marketing and/or sales functions by providing legal expertise or opinions.
  • Assist clients with the MSA submissions process regarding compliance and appropriate alternatives.
  • Adhere to Corporate and departmental policies and procedures, including HIPAA requirements.
  • Adhere to all safety, health rules/regulations and security associated with this position and as directed by supervisor.
  • Maintain confidentiality of all client and company proprietary information and/or sensitive subject matter.
  • Perform miscellaneous duties as assigned.


Qualifications

  • Must be a Juris Doctor from an accredited Law School
  • A minimum of one year prior legal experience required
  • Must be a licensed attorney and in good standing to practice law
  • Holds the Medicare Set-Aside Consultant Certified (MSCC) credential or must agree to obtain credential within 12 months post hire
  • Personal computer skills including electronic mail, word processing, spreadsheet, graphics, etc.
  • Must be proficient in multiple software programs, including, but not limited to, Microsoft Word, Excel, Access, PowerPoint and the Internet
  • Must be able to maintain confidentiality
  • Must be able to demonstrate team behavior and promote a team-oriented environment
